QTTX130577 with our NYC Steam Engine on it was delivered to WVRR for the second time around noon on February 24.  This time we were watching for it, and as soon as C&NC’s locomotive removed from our set off track, we entered, coupled to it, and moved it to our yard.  We did not want to take the chance that C&NC might change their mind again.

 

As you probably know, the car was delivered to us by C&NC on November 10, 2005.  A few hours later C&NC, without our permission or clearance, reentered our track and removed it.  To this date WVRR really does not understand why C&NC did this, nor has C&NC offered any logical explanation.  At the time, C&NC’s position was that they sort of got to thinking that perhaps they sort of needed permission from the car owner and the FRA before they could deliver it.  However, both immediately explained to C&NC that was not the case.

 

After a three month legal battle, C&NC performed this second delivery under the same terms and conditions as the first one, that they made over three months ago.
